Tech Caddie, Inc. Terms of Service

1. Acceptance of Terms
By accessing or using the services provided by Tech Caddie, Inc. (“Tech Caddie” or “we”), you (“User” or “you”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use our services.
2. Scope of Services
Tech Caddie provides technology support services, including but not limited to troubleshooting, installation, maintenance, and consultation (“Services”). Tech Caddie does not guarantee that the Services will resolve your issues or meet your expectations.
3. Subscription Service
Tech Caddie operates as a subscription service. By subscribing, you agree to pay a recurring monthly fee (“Subscription Fee”) for access to our Services. Details of the Subscription Fee and billing cycle will be provided at the time of subscription.
3.1 Billing and Payment
- Subscription Fees will be automatically charged to the payment method you provide on a monthly basis.
- You are responsible for ensuring that your payment information is accurate and up-to-date.
- If a payment is not successfully processed due to expiration, insufficient funds, or other issues, Tech Caddie reserves the right to suspend or terminate your access to the Services until payment is received.
3.2 Cancellation
- You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing cycle.
- No refunds will be provided for partial months or unused Services within a billing cycle.
3.3 Changes to Subscription Fees
Tech Caddie reserves the right to modify the Subscription Fee at any time. Changes will be communicated to you in advance and will take effect at the start of the next billing cycle. Your continued use of the Services constitutes your agreement to the new fees.
4. No Warranties or Guarantees
ALL SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Tech Caddie does not warrant that:
- The Services will be uninterrupted, error-free, or secure.
- The results obtained from using the Services will be accurate or reliable.
- Any issues with your technology will be resolved.
5. Limitation of Liability
To the fullest extent permitted by law, Tech Caddie shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from or related to your use of the Services, even if Tech Caddie has been advised of the possibility of such damages.
6. Indemnification
You agree to indemnify, defend, and hold harmless Tech Caddie and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney’s fees, arising out of or connected to your use of the Services or your violation of these Terms.
7. User Responsibilities
- You are responsible for providing accurate information and access to your devices as needed for Tech Caddie to perform the Services.
- You must back up your data prior to using the Services. Tech Caddie is not responsible for data loss during or after the Services.
- You agree not to misuse the Services, including but not limited to engaging in illegal activities or attempting to disrupt the functionality of Tech Caddie’s systems.
8. Termination
Tech Caddie reserves the right to terminate or suspend your access to the Services at any time, for any reason, without prior notice. If termination occurs due to non-payment, access will be restored upon receipt of payment.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Deleware, without regard to its conflict of laws principles.
10. Dispute Resolution
Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in [Insert City, State], and judgment on the award rendered may be entered in any court having jurisdiction.
11. Modifications to Terms
Tech Caddie reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
12. Entire Agreement
These Terms constitute the entire agreement between you and Tech Caddie regarding the use of the Services and supersede any prior agreements.
